Justice Benson Anya of an Abia State High court sitting at Nkwoagu Isuochi in Umunneochi judicial division has refused a bail application filed by one Obika Peter, who is standing trial for allegedly having sexual intercourse with a four-year-old girl.

The bail application was refused against the defendant, who is in protective prison custody pending the final determination of the case.

The defendant in a suit marked HUM/1CM/2022, between Obika Peter (Applicant/Defendant) and the State ( Respondent /Applicant), was said to have forced a four-year-old girl into sexual intercourse.

Justice Anya in his ruling stated: “ I have carefully perused the application for bail and all the processes in the file.

“ In view of the fact that this type of offence has become very rampant, it would not be proper to unleash the defendant on innocent girl toddlers of Umunneochi.

“The charge, I see in the file to my mind, has been thoroughly watered down to give the defendant an escape route after sexually molesting a four-year-old girl. The prosecution ought to charge the defendant under the criminal code.

“ I hereby refuse to grant the applicant bail and order that the applicant is kept in protective prison custody pending the final determination of the case.”
